Public Consultations
In accordance with Art. 52 KomG, the Office for Communications must publish measures which are likely to have a significant impact on the relevant market or specific user groups in electronic form, unless there are overriding public or private interests to the contrary.
Information on regulation and market supervision, in particular on public consultations, must be published in an appropriate manner in accordance with Art. 53 KomG, taking into account data protection legislation, official secrecy and professional, business and trade secrets.
In accordance with Art. 58 KomG, the Office for Communications may grant interested parties the opportunity to comment within a reasonable period of time on draft measures or recommendations which it intends to take or with which it intends to impose restrictions.
EEA-wide Consultations
If the Office for Communications intends, within the framework of the coordination procedure pursuant to Art. 40 VKND, to take a measure that falls under Art. 25 para. 2 KomG and would have an impact on trade between EEA Member States, it shall publish the draft measure and at the same time forward it to the EFTA Surveillance Authority, BEREC and the national regulatory authorities of the other EEA Member States for comment within one month and state the reasons for the measure.
